Terms of Service

These Terms of Service ("Terms") govern photography services provided by NZM Media ("we", "us", "our") of Fort St. John, British Columbia, to you ("the Client"). By booking a session or event with us, you agree to these Terms.
1. Bookings & Deposits
A booking is confirmed once a non-refundable retainer (deposit) is received and the session date is agreed in writing. The retainer reserves your date and is applied toward your total balance. Dates are held on a first-come, first-served basis and are not guaranteed until the retainer is paid.
2. Payment
The remaining balance is due on or before the day of the session unless otherwise agreed in writing. Prices are quoted in Canadian dollars (CAD). Galleries are delivered only after the balance is paid in full. Late payments may delay delivery.
3. Cancellations & Rescheduling
Retainers are non-refundable. If you need to reschedule, please provide at least 48 hours' notice and we will make reasonable efforts to accommodate a new date, subject to availability. Cancellations made with less than 48 hours' notice may incur the full session fee. We reserve the right to reschedule due to illness, equipment failure, or unsafe conditions, in which case your retainer will be honoured toward the new date.
4. Travel
Sessions within Fort St. John city limits are included at no additional charge. Travel beyond city limits is billed at $1.20/km (return distance) and is confirmed at the time of booking.
5. Image Delivery
Final images are professionally edited and delivered digitally via an online gallery. Portrait galleries are typically delivered within the timeframe communicated at booking; event galleries are delivered within 7–10 business days (corporate: 5–7 business days). The number of delivered images reflects the package selected. Additional images may be available for purchase.
6. Second Shooter
Where a second shooter is required or requested for event coverage, an additional charge applies and is negotiated with the Client prior to the event.
7. Copyright & Usage
NZM Media retains copyright of all images. Clients receive a personal-use licence to print and share delivered images for non-commercial purposes. Corporate packages include commercial usage rights for the Client's internal and marketing use as described in the relevant package. Images may not be edited, re-filtered, or sold without written permission.
8. Portfolio & Promotion
We may use selected images from your session in our portfolio, website, and social media for promotional purposes. If you prefer your images remain private, please tell us in writing before the session and we will honour your request.
9. Limitation of Liability
In the unlikely event of equipment failure, data loss, or other circumstances beyond our reasonable control that prevent delivery, our liability is limited to a refund of fees paid for the affected session. We are not liable for indirect or consequential losses.
10. Force Majeure
We are not responsible for failure to perform due to events beyond our control, including weather, illness, natural disasters, or government restrictions. In such cases we will work with you to reschedule.
11. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the applicable laws of Canada.
